Western New York DWI Defense Lawyers
How We Can Help With a DWI or DUI
Challenge The DWI or Drunk Driving Charge! We can contest the DWI charge by checking if:
(a) your constitutional rights were violated during the DWI stop
(b) the individual that stopped you was qualified by state laws
(c) the evidence collected holds up and is accurate
License Suspended? If your license has been suspended, we can work with the courts on getting you a temporary driving permit, also called a conditional license. This is an option if this is your first DWI or DWAI conviction and/or if you enroll in the New York Drinking Driver Program (DDP).
What is a DWI?
Driving while under the influence of alcohol is referred to as a DWI (Driving While Intoxicated) in New York State. In other states, a similar charge is referred to as a DUI (Driving Under the Influence).

In New York, individuals meet the criteria for a DWI if their Blood Alcohol Content level (BAC) is:
- 08% and they are 21 years old or older
- 04% and they are driving a commercial motor vehicle
- 02% and they are younger than 21 years old
However, DWI is only one of many charges that someone can be charged with. Other charges depend on the specific circumstances of the situation and include:
- DWAI/Alcohol: Driving While Ability Impaired, specifically by alcohol (Drunk Driving)
- DWAI/Drugs: Driving While Ability Impaired by a drug other than alcohol
- DWAI/Combination: Driving While Ability Impaired by both alcohol and other drugs
- Aggravated DWI (A-DWI): Aggravated driving for having a 0.18% BAC or higher
